1. Hong Kong hotel licensing business

Generally speaking, there are two kinds of hotel license, one is the hotel license, and the other is the bedspace apartment license.

Hotel license:

According to the hotel regulations, "the hotel" refers to any place, its occupant, whose proprietor or tenant display within the scope of the he can provide accommodation, he will give in to the places near the place of anyone to provide accommodation, which appears to be capable and willing to pay for the services and facilities provided payment is reasonable, and rent out period less than 28 days in a row.

 

A hotel (hotel) licence is required for the following premises:

 

A hotel for tourists

 

B. Hotels in buildings other than hotels

 

[C] a building designed for hotel use

 

[D] hotels for locals

 

E. motels

 

F. Accommodation for holidaymakers

 

G. a holiday camp

 

In addition, licensed premises should not be located in industrial buildings or premises.

 

 

A person who intends to open a hotel must apply for a full licence before commencing business.A licence may be valid for 12 to 84 months and must be renewed upon expiry. A licensee must apply for renewal at least 3 months before the expiry of the licence.

Bedspace apartment licence:

According to "by law of beds apartment," - "means for single accommodation or quasi for single accommodation floor space framework, bed or beds, while" beds apartment "means there were a dozen or more is occupied by a person under the lease agreement or quasi beds for under the lease agreement to take up any living unit, or in the same building units and the interval between the wall has been down two or more adjacent residential units, and in determining whether any living unit form beds apartment, should ignore the living unit in any interval does exist. 2. Hong Kong Hotel License requirements

Building safety and health requirements:

 

The premises must:

 

Comply with the following requirements in the code issued by the buildings department, including

Code of practice on provision of fire escape routes

 

Code of fire resisting structures

 

Code of fire and rescue access

 

Compliance with minor works control system legislation;

 

No unauthorized buildings;and

 

Equipped with:

 

Proper lighting and ventilation;and

 

Adequate hygiene facilities, i.e., water toilets, washbasins, bathtubs and/or shower facilities;And adequate water and drainage systems.

 

Fire safety regulations:

 

The premises must comply with the requirements issued by the fire services department:

 

The minimum code of fire services installations and equipment and code of inspection, testing and maintenance of installations and equipment;

 

Requirements of the building (ventilation systems) regulations;

 

Requirements of the electricity (wiring) regulations and other codes of works for fixed electrical installations;and

 

The use and installation requirements of gas works under the gas safety ordinance (cap. 51).

 

 

Location:

 

In selecting the hotel premises, the applicant should pay attention to the following:

 

1. Premises must be approved by the building authority for accommodation or hotel use

 

Road premises or residential village houses in the New Territories.

 

2. A deed of mutual covenant is a private deed entered into by the owner, the property manager and the developer of a building. Each party may, in accordance with the powers conferred by the deed of mutual covenant, execute the deed of mutual covenant of responsibility for the control, management and administration of the building and take appropriate action and measures against the owner who breaches the deed of mutual covenant.A licensed hotel operator is one of the users of the building and is obliged to observe and comply with all the provisions of the deed of mutual covenant.A licence issued by the hotel industry authority does not release from any lease, tenancy agreement or any provision contained in the licence granted by the government, nor does it affect or change the provision of the deed of mutual covenant or other deed of the premises in which the hotel is located.A licensee who contravenes the law, the deed of mutual covenant or any other deed shall bear all consequences and responsibilities and shall not be exempted or protected by the issuance of a licence.Where necessary, the applicant should seek relevant legal advice.(copies are available at the land registry

3. If the approved plans of the premises are for non-domestic use, prior written consent of the building authority with respect to conversion of the premises to hotel use as specified in the buildings ordinance (cap. 123) must be obtained from the building authority.Otherwise the hotel industry authority may refuse the application under the hotel industry ordinance.If the premises are rural village houses in the New Territories, they must meet the requirements of the buildings ordinance (application to the New Territories) ordinance (cap. 121);and

 

Obtain a certificate of eligibility or no objection from the lands office of the lands department.

 

4. The hotel industry authority will not issue a hotel licence to premises located at -

 

Industrial buildings;

 

The basement;

 

Unauthorized buildings;

 

A building containing shops for any of the following trades

 

Car repair shop;

 

Vulcanization industry shop;

 

Car or carriage painting workshop;And ╱ or

 

A paint shop that manufactures or mixes paints or varnishes.

 

Emergency or access areas such as fire barriers and public areas of buildings;

The place of manufacture of any dangerous goods referred to in the dangerous goods ordinance (cap. 295);Or adjacent to the place where dangerous goods are stored;

 

Is not issued by the building authority in August 1996 the code to provide fire escape route (code escape route) is equipped with two or more stairs (each stair at least 1050 mm 濶) building the upper * (i.e., all the floors above ground) (unless the building in conformity with the 1996 code escape way about single ladder building requirements);Or the upper * (i.e. all floors above ground level) of a single-staircase building, but not in accordance with the requirements of the code of means of escape promulgated in 1996.

 


3. How to apply for or purchase a Hong Kong hotel license

Documents to be submitted together with the application form:

 

1) the completed original application form together with a copy;

 

2) photocopy of the applicant's identity card for individuals;Photocopy of business registration certificate if the applicant is a limited company;

 

3) if the applicant is not a Hong Kong permanent resident, he/she should submit a photocopy of the consent form and his/her travel document duly completed in annex I to the application form;

 

4) photocopy of hotel business registration certificate (to be submitted before the issue of the licence);

 

5) third party risk insurance (public liability insurance policy certificate copy (such as the effective insurance policy issued by insurance company, insurance certificate, etc.), relevant policy must be included in the insurance period on the licensed premises for every accident provide port of not less than 10 million yuan of the limit of indemnity and no upper limit of indemnity accidents (such as the required insurance data not presented in the application form, can be submitted before a licence).

 

6) three copies of the plan using decimal units and in proportion (generally not less than 1:100);The plan should clearly show the boundary of the hotel licence application and the internal space;

 

7) written approval/consent of the building authority to change the hotel premises from non-domestic use to domestic use (if the hotel premises are located on premises approved by the building authority for non-domestic use);

 

8) certificate of eligibility or non-objection to stay issued by the lands office of the lands department (e.g. the location of the hotel is a village house in the New Territories).

 

If the applicant fails to provide complete information, the application may not be accepted.

 

The space plan submitted by the applicant must contain the following information -

1) the scope of the licence;

 

2) intended use within the scope of the licence and of all rooms, with dimensions and additional notes;

 

3) existing and/or proposed construction works on the premises;

 

4) type, standard and specification of all spacer materials and installations existing or intended to be used on the premises;

 

5) all existing and/or proposed health facilities and existing and/or proposed drainage works;

 

6) location of Windows, ventilation ducts and mechanical ventilation system;

 

7) the scope and details of all elevated platforms, spacer walls and other alterations;And the location, scope and details of the reception counter with staff on duty 24 hours a day.
